E-C Translation Strategies and Techniques of Business Contracts from the Perspective of Skopos Theory

摘要

近年来，随着国际贸易的快速增长和经济全球化，我国的对外贸易取得了令人瞩目的成绩。与此同时，在商务合同翻译过程中，中国仍然面临着许多棘手的问题。作为法律文件，商务合同要求翻译具有准确性和专业性以确保合同各方的合法权益以及追求他们的利益。商务合同有各种各样不同的要求，因此，想要高质量地翻译一篇商务合同绝非易事。

本文分为四个部分：第一部分介绍商务合同的背景知识，包括商务合同的定义、结构及特点，如术语、难句等；第二部分概述了目的论的定义、起源、三大原则（目的原则、连贯原则、忠诚原则）以及两大评价标准（对等性和充分性）；第三部分分析了在商务合同翻译过程中常用的翻译策略与技巧，包括归化与异化策略；为提高商务合同的汉译质量，作者还阐述了行之有效的翻译技巧，如词类语态的转化、增词减词、分译。通过使用这些策略与技巧，高质量的商务合同可以更紧密地联系合同双方的关系，实现双方共赢。

Abstract

With the rapid growth of international business and economic globalization in recent years, the volume of foreign trade in China has amounted to an amazing figure; meanwhile, China obviously faces many tough problems in E-C translation process of business contracts. As legal documents, the business contract requires preciseness and expertise in order to guarantee the rights and interests of each and every party who is related to the business contract. It is difficult to make a quality E-C translation of the business contract because of the distinct requirements above. 

This thesis is divided into four parts. The first part introduces the background information of the business contract including its definition, formation and such language features as terminology, complicated sentences etc.. Then it goes to the overview of the Skopos Theory, inclusive of its definition, origin, three main rules -- Skopos Rule, Coherence Rule and Fidelity Rule, and two evaluation standards -- equivalence and adequacy. The third part analyzes the translation strategies and techniques commonly used in the translation process of business contracts, which cover domestication and foreignization, in addition, four effective translation techniques are also illustrated in order to improve the quality of translation，namely conversion of parts of speech, conversion of voices, addition, omission and division. By using these strategies and techniques, the quality business contract can connect every party’s relationship tightly and achieve mutual benefits.
