Abstract

The interrogation process is a very important component of the judicial life and a central and indispensable part of the criminal investigation. This paper studies interrogation processes selected from the American crime drama television series Crime Scene Investigation with Paul Grice’s Cooperative Principle and its four maxims being its theoretical framework. The selected interrogations are detailedly analyzed to find out how suspects violate the Cooperative Principle in interrogation processes and how conversational implicature is thence produced. Through the analyses of eight typical examples, we find that during interrogations, suspects alternately violate the four maxims of the Cooperative Principle. They often provide false information or refuse to provide accurate information because they want to evade legal responsibilities or cover up the criminals. All these tricks of the suspects will mislead investigators or they may set up obstacles to the further detection of the case in question. This paper aims to inspire investigators to figure out the linguistic tricks used by suspects to violate the Cooperative Principle and the conversational complicature thus produced, find out the facts of the crime, and accelerate the solution of various cases in the real world.

摘要

    案件讯问是司法生活中一个非常重要的组成部分,是刑事侦查活动的首要和中心环节。本文以格赖斯的合作原则及其四准则为理论框架,对美国刑侦剧《犯罪现场调查》中具有代表性的案件讯问过程进行分析,研究讯问过程中犯罪嫌疑人对侦查人员的查问的回答和申辩,详细探究犯罪嫌疑人对合作原则的违反及由此产生的会话含义。通过对八个典型案例的文本分析发现:在案件讯问过程中,犯罪嫌疑人常常会为了逃避法律责任或包庇他人,故意采取一些语言手段,交替违反合作原则下的四条准则,提供虚假信息或拒绝提供准确信息,从而混淆视听、模糊犯罪事实,给侦查人员的信息获取造成了困难,为案件的进一步侦破设置了障碍。本文的目的在于启发侦查人员识破案件讯问过程中犯罪嫌疑人对合作原则的违反,指出犯罪嫌疑人所使用的各种语言手段下所隐藏的会话含义,以摸清犯罪事实,发现新线索,推动案件的尽快侦破。

Chapter One Introduction
The interrogation process, as a central and indispensable part of the criminal investigation activity, refers to the process in which criminal investigators question suspects about the case-concerned facts, and listen to their explanations and pleas so that to find out more clues and evidences, make clear the facts, speed up the investigation and finally track down the case. In today’s interrogation processes, torture and such kind of abusive investigative techniques are rare.
