Abstract
This Paper studies the popularity and strong vitality of the “Relative Concealment” in ancient China. From systemic functional linguistic perspective, this paper analyzes sections and chapters from Confucian classics that embodied the philosophy of “concealment of offenses by close relatives” (hereinafter referred to as “Relative Concealment”), in combination with criminal case adjudication in light of the Spring and Autumn Annals, so as to do some case studies. Though contrast, association, and summary, it clarifies the law value of the principle, and probes into its profound influence on ancient Chinese legal culture.
The “Relative Concealment” regulation has three aspects of effects in the ancient traditional legal culture,such as the social justice and moral tolerance towards family affection, family as a conceptual legal subject, and law as elusive in face of kinship. All above legal culture researchers has done a lot about the above statements. The innovation of this paper is, based on the systematic linguistic view of field, tenor, and mode, to find intertextual link and logical illustration between criminal case adjudication in light of the Spring and Autumn Annals and “Relative Concealment”, thus it can provide more materials to support the Confucianization of law.

本文从三个部分探讨了“亲亲相隐”在古代中国所具有的普遍性和强大生命力,从系统功能语言学角度分析儒学经典著作中体现“亲亲相隐”理念的篇章,并结合“春秋决狱”的判案案例,对其进行语言学的实例研究。通过对比、归纳、总结的方法,阐明了“亲亲相隐”制度与其所具有的法律价值,进而探究其对中国古代法律文化产生的深刻影响。
我国古代“亲亲相隐”制度对中国传统法律文化的影响体现在对亲情的正视和宽容、把家庭“法人化”的倾向和国家利益向亲情权利的妥协。以上关于“亲亲相隐”对中国古代法律儒家化的影响,法律文化研究者已有定论,但微观上尚缺少文本相关性的实例研究。所以本文所做的创新工作,是根据系统语言学的语场、语旨与语式,讨论“春秋决狱”的判例与儒家“亲亲相隐”的互文体现关系及其逻辑例证,从而为法律儒家化的命题提供更多的材料支撑。
