摘要

立法语言作为立法工具，是法律信息的载体。然而，在目前已经颁布的法律法规中，在词语、语法和逻辑方面呈现的问题并非少数。因此，如何实现立法语言的规范化是我国在立法实践中必须解决的问题。

文章分别从五个方面进行了分析：第一部分说明了国内的研究现状及存在的不足之处。第二部分指出了研究立法语言规范化的意义，同时也从语言角度和法律专业角度阐述了立法语言规范化的标准。第三部分从形式问题和实质问题这两个层面列举出来了法律文本中存在的失范化现象，包括动宾搭配不当、标点符号使用不当、语义不明以及存在常识性语病等等。第四章则分析了形式问题和实质问题产生的原因，包括重视内容而忽略表达形式，受汉语“直觉思维”影响严重，缺乏对立法语言的专门规定以及没有处理好准确性和模糊性、专业化与普通化的矛盾。第五部分基于失范化现象存在的影响，即增加了立法难度、影响立法法的实施以及破坏语言规则，进而提出了一些解决办法来探寻立法语言的规范化路径，如：树立语言规范意识、建立专家参与立法起草制度以及建立完整的语言审查程序。本文的总体思路是发扬立法语言普通性的优点，避免其缺点。笔者研究了如何处理好规范性和普通性这对矛盾的问题，以期望能够对立法语言的规范化起到一定促进作用。
